The Principles of Maliki Doctrine: Their Significance and Ability to Enhance Contemporary Ijtihad for Developing a Conciliatory Jurisprudence System

This study aims to identify the principles of Maliki doctrine. It focuses mainly on ijtihad guidelines, which help in the construction of an innovative, conciliatory jurisprudence system capable of answering the emerging issues of this era. The research highlighted overlapping in the doctrine’s principles, with a view to identifying the areas of consensus, which would help in building this conciliatory system. The discussion uses an inductive approach, as it explores the main authentic Maliki books to infer the doctrine's principles of ijtihad. It also adopts the descriptive and analytical methods to identify the areas of overlapping and similarity with
other doctrines. The originality of this research lies in that it deals with contemporary ijtihad and aims at developing it to meet requirements of the current era. This is achieved through building on the principles of Islamic doctrine rather than ignoring them. The paper concluded that Maliki
doctrine has ijtihad principles more than any other doctrine, which makes it suitable for contemporary ijtihad. Moreover, it was found that most ofthe ijtihad principles existing in other doctrines are also present in Maliki doctrine, leading to a higher degree of consensus among all doctrines.
